Synthetic Discord Bot Terms of Service (TOS)

By using Synthetic ("the Bot"), you agree to these Terms of Service (the "Terms"). Please read these Terms carefully before using the Bot. If you do not agree to these Terms, you may not use the Bot.

1. Acceptance of Terms

By inviting the Bot to your server or interacting with the Bot, you accept and agree to be bound by these Terms. If you are using the Bot on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of the Bot

Synthetic is an AI-powered Discord bot that provides text and image generation using AI models. The Bot is designed to allow users to send prompts to AI models and get responses.

3. User Responsibilities:

• Compliance: You agree to use the Bot only for lawful purposes and in accordance with these Terms. You must comply with all applicable laws and regulations when using the Bot.
• Prohibited Conduct:You agree not to:
  • Use the Bot for spamming, harassing, or illegal activities.
  • Share or submit offensive, harmful, or abusive content.
  • Attempt to exploit vulnerabilities or gain unauthorized access to the Bot or related systems.
  • Use the Bot in a manner that disrupts or degrades the Bot’s performance or service.

4. Privacy and Data Collection

• Data Collection: The Bot may collect data from your interactions, including but not limited to messages, server information, and usage statistics. This data is used to improve Bot functionality and user experience.
• Data Usage: We will handle your data in accordance with our Privacy Policy, which outlines how we collect, store, and use your data.

5. Intellectual Property

• Ownership: Synthetic and its associated intellectual property (including logos, code, and design) are owned by KHV Digital LLC. You may not copy, modify, or redistribute any part of the Bot’s code or assets without explicit permission.

6. Bot Availability and Downtime

While we strive to keep the Bot available 24/7, we do not guarantee uninterrupted access. The Bot may experience downtime due to maintenance, updates, or unforeseen technical issues. We are not responsible for any loss of data or service interruptions.

7. Modifications to the Bot and Terms

We reserve the right to modify, suspend, or discontinue the Bot at any time, for any reason, without notice. Additionally, we may update these Terms from time to time. Any changes to the Terms will be posted here, and by continuing to use the Bot, you agree to the updated Terms.

8. Limitation of Liability

To the fullest extent permitted by law, KHV Digital LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to data loss, service interruptions, or financial losses, arising out of or related to the use of the Bot.

9. Indemnification

You agree to indemnify and hold harmless KHV Digital LLC and its affiliates, employees, and contractors from any claims, losses, or damages, including legal fees, arising out of your use of the Bot or any violation of these Terms.

10. Termination

We reserve the right to terminate or suspend your access to the Bot at our sole discretion, without notice, for any reason, including but not limited to violations of these Terms or misuse of the Bot.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the competent courts of the United States.
